Welcome to BusinessHeadshots.com ("we," "us," or "our"), a service provided by Castwell OÜ designed to help businesses manage team photos and generate professional, uniform headshots. By accessing or using our website, API, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms apply to all users, including individuals, businesses, or organizations ("you" or "your") using the Service, whether through our free tier or paid tier. BusinessHeadshots.com provides a platform for team photo management and AI-generated headshots.
Our primary focus is enabling businesses to:

• Connect the Service to HR systems or Active Directory software via API for seamless team photo management.
• Automatically import employee names, photos and email addresses (where available).
• Invite team members to upload photos, which are processed to generate company-style headshots based on predefined settings.

The Service includes:

• A Free Tier: Basic team photo management features at no cost.
• A Paid Tier: Purchase credits to generate AI headshots, with additional features and customization options.

To use the Service, you must:

• Be at least 18 years old or have the legal authority to represent a business or organization.
• Have the authority to bind your company or organization to these Terms if you are signing up on their behalf.

• You must create an account to use the Service. You agree to provide accurate and complete information during registration and to keep it updated.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
• Notify us immediately at support@businessheadshots.com if you suspect unauthorized use of your account.

4.1 Free Tier

• The Free Tier provides access to basic team photo management features, including the ability to organize and store team photos.
• No credits or headshot generation are included in the Free Tier.
• We reserve the right to modify or discontinue the Free Tier at any time with notice.

4.2 Paid Tier

• The Paid Tier requires purchasing credits, which are used to generate AI headshots.
• Credits are non-transferable and non-refundable except as outlined in Section 7 (Refunds).
• Pricing and credit packages are available on our website and may change with prior notice.

• The Service offers an API for integration with HR systems or Active Directory software.
• You are responsible for ensuring your use of the API complies with these Terms and any applicable third-party software terms.
• We provide API documentation but are not responsible for your implementation or any issues arising from your systems.

• You and your team members may upload photos or other content ("User Content") to the Service.
• By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, process, and modify it solely as necessary to provide the Service to you (e.g., to generate headshots or manage team photos). We do not use your User Content for any purpose outside of delivering the Service to you, and we do not claim ownership of it. Your User Content remains yours.
• You represent that you have the rights to upload User Content and that it does not violate any laws or third-party rights (e.g., privacy, intellectual property).
• We may remove User Content that violates these Terms or applicable laws.

• Credits are non-refundable except when none of the generated headshots during a single photoshoot meet your satisfaction.
• To request a refund, submit a complaint to support@businessheadshots.com with details of the issue.
• Refund requests are evaluated on a case-by-case basis at our sole discretion. If approved, we will either restore the affected credit(s) to your account or issue a monetary refund, as determined by us.

• We own all rights to the Service, including its software, algorithms, and generated headshot templates (excluding User Content).
• Headshots generated by the Service may be used by you for business purposes, but you may not resell or redistribute them without our permission.

You agree not to:

• Use the Service for illegal purposes or to upload harmful or offensive content.
• Attempt to reverse-engineer, hack, or interfere with the Service.
• Overload or misuse the API beyond reasonable business use.
• Use the Service to generate headshots for non-business purposes without our consent.

• You may stop using the Service at any time by closing your account.
• We may suspend or terminate your access if you violate these Terms, with or without notice.
• Upon termination, your right to use the Service ends, but these Terms’ provisions on intellectual property, liability, and disputes survive.

• The Service is provided "as is" without warranties of any kind, express or implied.
• We do not guarantee that generated headshots will meet your expectations or that the Service will be uninterrupted or error-free.

• To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the Service.
• Our total liability to you will not exceed the amount you paid us in the past 12 months.

You agree to indemnify and hold us harmless from any claims, losses, or damages arising from your use of the Service, your User Content, or your violation of these Terms.

• We may update these Terms from time to time. We will notify you of material changes via email or through the Service.
• Continued use of the Service after changes constitutes acceptance of the updated Terms.

• These Terms are governed by the laws of Estonia.
• Any disputes will be resolved exclusively in the Harju County Court, Tallinn, Estonia.
